1. ACCEPTANCE OF TERMS
By purchasing practitioner access or client licences to the 'Why Do I Feel This Way?' educational therapy series ("the Course"), you ("Practitioner" or "Client") agree to be bound by these Terms and Conditions ("Terms").
These Terms constitute a legally binding agreement between you and Live Life Empowered, operated by Live Life Empowered ABN: 26220429432 ("Live Life Empowered," "we," "us," or "our").
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PURCHASE OR ACCESS THE COURSE.
2. DEFINITIONS
"Course" refers to the 'Why Do I Feel This Way?' educational therapy video series, including all 15 modules and associated materials.
"Gateway Package" refers to the practitioner access package priced at $249 AUD, which includes lifetime practitioner access plus 5 client licences.
"Practitioner" refers to any mental health professional, therapist, counsellor, psychologist, social worker, or similar professional who purchases the Gateway Package.
"Client Licence" refers to a single-user lifetime access licence to the Course content, granted to an individual client by a Practitioner.
"Additional Licences" refers to client licences purchased beyond the 5 included in the Gateway Package, available in packs of 5 ($99 AUD) or 10 ($189 AUD).
"Platform" refers to Kajabi and any other technology platform used to deliver the Course content.
"Content" refers to all video recordings, audio, text, graphics, images, and materials included in the Course.
3. PRACTITIONER ACCESS AND LICENSING
3.1 Gateway Package Purchase
By purchasing the Gateway Package ($249 AUD), Practitioners receive:
- Lifetime personal access to all Course content
- Five (5) Client Licences for distribution to individual clients
- Exclusive access to purchase Additional Licences at practitioner rates
- Technical support for platform access issues
3.2 Additional Licence Purchases
Practitioners may purchase Additional Licences at any time:
- 5-pack: $99 AUD (5 Client Licences)
- 10-pack: $189 AUD (10 Client Licences)
Additional Licences are available exclusively to Practitioners who have purchased the Gateway Package. These rates are not available to the general public.
3.3 Licence Distribution
Practitioners are solely responsible for:
- Selecting appropriate clients to receive access
- Granting access through the Platform as instructed
- Tracking the number of licences distributed
- Ensuring therapeutic appropriateness of Course content for each client
- Maintaining professional standards in all client interactions
3.4 No Licence Expiry
Client Licences do not expire. Practitioners may purchase Additional Licences and distribute them at their own pace, with no time restrictions on unused licences.
3.5 No Licence Transfers or Reassignments
Once a Client Licence is granted to a specific individual (identified by email address), it cannot be:
- Transferred to another person
- Revoked and reassigned
- Sold or resold
- Shared among multiple users
Each Client Licence is permanently bound to the individual to whom it is first granted.
4. CLIENT ACCESS
4.1 Individual Access
Each Client Licence provides one individual with:
- Lifetime access to all Course content
- Independent login credentials
- Ability to access content on multiple personal devices
- Self-paced learning with unlimited content reviews
4.2 Access Duration
Client access remains active for the lifetime of the Course, defined as the period during which Live Life Empowered maintains the Course on the Platform. While we have no current plans to discontinue the Course, we reserve the right to do so with 90 days' notice.
4.3 Account Security
Clients are responsible for:
- Maintaining confidentiality of their login credentials
- All activity that occurs under their account
- Notifying us immediately of any unauthorised access
- Using the Platform in compliance with these Terms
5. PERMITTED USE
5.1 Personal Learning and Professional Reference
Practitioners may:
- Access Course content for personal professional development
- Reference Course concepts in therapeutic sessions
- Recommend specific modules to clients
- Discuss Course content with clients in treatment context
- Use Course content to inform therapeutic approach
Clients may:
- Access Course content for personal healing and growth
- Watch videos multiple times at their own pace
- Take personal notes for their own use
- Discuss content with their Practitioner
- Apply learnings to their personal life
5.2 Permitted Technical Use
Users may:
- Stream content on multiple personal devices
- Access content from different locations
- Use content offline if platform features allow (where technically supported)
6. PROHIBITED USE
6.1 Strictly Prohibited Actions
Users may NOT:
- Share login credentials with others
- Download, record, or reproduce Course content
- Distribute, sell, or resell access to Course content
- Use content for any commercial purpose beyond the licensed use
- Publicly share, broadcast, or display Course content
- Upload Course content to social media, file-sharing sites, or public platforms
- Create derivative works based on Course content
- Remove or alter copyright notices or branding
- Use automated systems (bots, scrapers) to access content
- Reverse engineer or attempt to extract source files
6.2 Practitioner-Specific Restrictions
Practitioners may NOT:
- Resell Client Licences at a markup
- Share practitioner checkout links publicly
- Grant access to anyone other than individual therapy clients
- Use content in group workshops without express written permission
- Incorporate Course videos into their own courses or programs
- Claim authorship or co-authorship of Course content
- Use Course content for research or publication without written consent
6.3 Client-Specific Restrictions
Clients may NOT:
- Grant access to family members or friends
- Use content in any professional or commercial capacity
- Share Course videos on social media or public platforms
- Create summaries, transcripts, or derivative materials for public distribution
7. INTELLECTUAL PROPERTY RIGHTS
7.1 Ownership
All Content, including but not limited to video recordings, audio, scripts, graphics, logos, and course structure, is the exclusive intellectual property of Live Life Empowered and its creators, Andrea and Josie.
The Course is protected by:
- Australian copyright law
- International copyright treaties
- Intellectual property laws
7.2 Limited Licence Grant
Purchase of practitioner access or a Client Licence grants only a limited, non-exclusive, non-transferable, non-sublicensable licence to access and view Course content for the permitted purposes outlined in Section 5.
This is a licence to access content, NOT a sale or transfer of any ownership rights.
7.3 Trademarks
"Live Life Empowered" and all associated logos, branding, and course titles are trademarks of Live Life Empowered. Unauthorised use is strictly prohibited.
8. PAYMENT TERMS
8.1 Pricing and Currency
All prices are stated in Australian Dollars (AUD) and are subject to change without notice. Price changes do not affect purchases already completed.
Current pricing:
- Gateway Package: $249 AUD
- 5 Additional Licences: $99 AUD
- 10 Additional Licences: $189 AUD
8.2 Payment Processing
Payments are processed securely through PayPal or Stripe. By providing payment information, you authorise us to charge the applicable fees.
8.3 Taxes
Prices may not include applicable taxes, duties, or fees. You are responsible for paying any applicable taxes in your jurisdiction, except where we are required to collect and remit such taxes.
8.4 No Refunds After Access
Gateway Package: Once practitioner account access is granted, the Gateway Package purchase is non-refundable.
Additional Licences: Once Additional Licences are added to a practitioner account, the purchase is non-refundable, regardless of whether licences have been distributed to clients.
Client Access: Once a Client Licence is granted and the client has received login credentials, that licence cannot be refunded.
8.5 Technical Issues Exception
If you experience technical issues that prevent access to the Course within 14 days of purchase, and we are unable to resolve these issues, you may be eligible for a refund at our discretion. Contact [email protected] to request technical assistance.
9. ACCOUNT TERMINATION
9.1 Our Right to Terminate
We reserve the right to suspend or terminate access to the Course if:
- You violate these Terms
- You engage in prohibited use as outlined in Section 6
- You distribute Course content without authorisation
- You engage in fraudulent activity
- You abuse the Platform or harass other users or staff
9.2 Effect of Termination
Upon termination:
- Your access to the Course will be revoked immediately
- No refund will be provided
- All licence grants are void
- Provisions regarding intellectual property and confidentiality survive termination
9.3 Client Access Continuity
If a Practitioner's account is terminated, clients who have already been granted access will generally maintain their access unless their individual accounts are also found to be in violation of these Terms.
10. CONTENT DISCLAIMER
10.1 Educational Purpose Only
The Course is designed for educational and informational purposes only. It is NOT:
- A substitute for professional medical advice, diagnosis, or treatment
- Psychotherapy or clinical treatment
- A crisis intervention service
- Personalised mental health care
10.2 No Professional Relationship
Accessing the Course content does not create a therapist-client relationship between clients and Andrea, Josie, or Live Life Empowered.
Practitioners maintain sole professional responsibility for their client relationships and treatment decisions.
10.3 Seek Professional Help

10.4 Content Accuracy
While we strive to provide accurate, evidence-based information:
- Content reflects current understanding as of the creation date
- Mental health research and best practices evolve
- Individual experiences may vary
- Content may not address all individual circumstances
11. LIMITATION OF LIABILITY
11.1 No Warranties
THE COURSE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free access
11.2 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIVE LIFE EMPOWERED, ITS CREATORS, AND ITS PARTNERS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Personal injury or emotional distress
- Damages arising from use or inability to use the Course
- Damages arising from unauthorized access to user accounts
11.3 Maximum Liability
Our total liability for any claims arising from or related to the Course shall not exceed the amount you paid for access to the Course.
11.4 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be lawfully excluded, restricted, or modified.
12. PLATFORM AND TECHNICAL REQUIREMENTS
12.1 Third-Party Platform
The Course is hosted on Kajabi, a third-party platform. We are not responsible for:
- Kajabi's terms of service or privacy policy
- Technical issues with Kajabi's infrastructure
- Changes to Kajabi's features or functionality
- Kajabi's data security practices
12.2 Technical Requirements
Users are responsible for:
- Internet connection and associated costs
- Compatible devices and browsers
- Maintaining device security
- Backing up any personal notes or materials
12.3 Platform Changes
We reserve the right to:
- Change the hosting platform with reasonable notice
- Update or modify Course content
- Temporarily suspend access for maintenance
- Make technical improvements
13. PRIVACY AND DATA PROTECTION
13.1 Privacy Policy
Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
13.2 Data Collection
We collect:
- Account information (name, email)
- Payment information (processed securely by third parties)
- Usage data (course progress, viewing patterns)
- Communications with support
13.3 Data Sharing
Practitioner information is never shared with clients. Client information is only visible to:
- The Practitioner who granted their access
- Live Life Empowered staff for support purposes
- Platform providers as technically necessary
13.4 Practitioner-Client Confidentiality
Practitioners are solely responsible for maintaining confidentiality in accordance with their professional standards and legal obligations. We do not intervene in or oversee practitioner-client relationships.
14. MODIFICATIONS TO TERMS
14.1 Right to Modify
We reserve the right to modify these Terms at any time. Changes will be effective:
- Immediately upon posting for new users
- 30 days after notification for existing users
14.2 Notification of Changes
We will notify users of material changes via:
- Email to registered account addresses
- Notice on the Platform
- Updated "Last Modified" date on this document
14.3 Continued Use Constitutes Acceptance
Your continued use of the Course after changes take effect constitutes acceptance of the modified Terms. If you do not agree with changes, discontinue use of the Course.
15. GENERAL PROVISIONS
15.1 Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or use of the Course shall be subject to the exclusive jurisdiction of the courts of Queensland.
15.2 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Live Life Empowered regarding the Course and supersede all prior agreements, understandings, or representations.
15.3 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
15.4 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
15.5 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
15.6 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, strikes, or failures of third-party services.
15.7 No Partnership
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Live Life Empowered.
15.8 Headings
Section headings are for convenience only and do not affect interpretation of these Terms.

17. DISPUTE RESOLUTION
17.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to first contact us to attempt to resolve the dispute informally.
17.2 Mediation
If informal resolution is unsuccessful, both parties agree to participate in good faith mediation before pursuing litigation.
17.3 Class Action Waiver
To the extent permitted by law, you agree to bring any claims against us only in your individual capacity and not as part of any class or representative action.
18. ACKNOWLEDGMENTS
By purchasing and accessing the Course, you acknowledge that:

ACCEPTANCE
For Practitioners: By completing your Gateway Package or Additional Licence purchase, you confirm that you:
- Are a qualified mental health professional
- Will use licences only for individual therapy clients
- Will maintain professional standards in all client interactions
- Understand and accept all Terms outlined in this document
For Clients: By accepting access granted by your Practitioner, you confirm that you:
- Have been granted access by a qualified practitioner
- Will use content for personal learning only
- Will not share access with others
- Understand and accept all Terms outlined in this document
